Our client was a 22 year old international student. He was stopped and searched by police where MDMA was found on his person. He was cooperative with police and he admitted that it was his intention to supply the drugs to his friends. He was subsequently charged. Our client instructed us to enter a plea of guilty at the earliest opportunity. He was facing a maximum penalty of two years imprisonment and/or a fine of $11000.
At sentencing our solicitor Alexander Angel-Graham made submissions in respect to the objective seriousness of the offence, various mitigating factors and our client’s subjective circumstances which included his intention to commence a career in engineering and remain in Australia.
A conviction in this case would have jeopardised his immigration status and his ability to work. The sentencing Magistrate sentenced our client to a Conditional Release Order without conviction for 12 months.
Our client was extremely happy with this outcome.
