Our client was a 26-year-old man who appeared before the District Court facing a number of serious criminal charges, including the offence of Robbery in Company. This offence is regarded by the courts as particularly serious and carries a maximum penalty of 20 years’ imprisonment.
Given the nature of the charge, the presence of aggravating features, and the fact that our client had prior matters on his criminal record, there was a real and substantial risk that the court would impose a full-time custodial sentence.
At sentence, Lamont Law appeared on behalf of the client and made detailed submissions addressing the objective seriousness of the offending, the surrounding circumstances, and the applicable sentencing principles. Careful submissions were also made in relation to the client’s subjective circumstances, including his background, personal history, prospects of rehabilitation and capacity to engage constructively with supervision in the community.
While acknowledging the seriousness of the offence and the aggravating features present, Alexander was able to persuasively argue that a sentence focused on rehabilitation rather than imprisonment was appropriate in the circumstances. Emphasis was placed on the client’s willingness to address underlying issues, his insight into the offending, and the availability of a structured sentencing option that would hold him accountable while reducing the risk of reoffending.
Ultimately, the sentencing Judge accepted these submissions and exercised discretion to impose an Intensive Correction Order (ICO) in place of a term of full-time imprisonment.
An ICO is a highly structured sentencing option involving intensive supervision in the community, strict conditions, and ongoing oversight by Community Corrections. It is widely regarded as a significant alternative to prison, particularly in serious matters where the court is satisfied that rehabilitation can be achieved outside a custodial environment.
This was an exceptional outcome given the seriousness of the charge and the client’s criminal history. The sentence allowed our client to remain in the community under strict supervision, continue addressing his personal circumstances, and avoid the profound consequences of a prison sentence.
